11/3/23 Eviction Status Update: As of November 3, the squatter in The Lithonia has vacated. Our Property Manager has regained possession and we are working closely with them to prepare the property for a new resident.

We are in the process of arranging an occupancy check in order to try to obtain contact information for C4Ks (presumably individuals or entities). 10/5/23 Eviction Status Update: On 9/22, the property manager confirmed that the tenant who canceled their lease has illegally moved into the home and is not paying rent or security deposit despite ongoing outreach from the property manager. The demand was made on 9/24 and filed on 9/28. As of 10/5, we are awaiting service.
9/19/23 Status Update: There was a misunderstanding with our property manager and the intended tenant did not move in or make any payments so we had to cancel the lease. The listing is active again on Zillow and other major rental sites. We are working with our property management team to find a new tenant.
9/8/23 Status Update: A lease has been signed and we have confirmed the tenant has moved in. The lease for this home started on September 6th at $2,995 monthly rent for 21 months.

As of June 1, 2023, the writ is being held up by the Marshall.
On June 14, 2023, Fulton County reported that they are nearly finished with the December 2022 writs. We will receive a notification when they begin working on the current writs.
5/30/23 Eviction Status Update: The eviction case was filed on August 30, 2022. As of May 26, an update on the court status revealed that the eviction is in progress, and the scheduling for the eviction is yet to be determined.

11/3/23 Eviction Status Update: On October 18, 2023, an occupancy check was scheduled for the upcoming Friday, with residents stating their intention to vacate. There is a remaining balance on the property. As of November, an occupancy check confirmed that the property is still occupied, with no other updates available.
10/5/23 Eviction Status Update: On 9/13, the property manager mentioned that the eviction should be scheduled for February 2024. This timeline is based on the average six-month period it takes for a writ to evict in Fulton. The property manager also mentioned that the tenant would voluntarily vacate the property on 9/22. As of 10/5, we are awaiting confirmation that the property management is in possession of the property.

6/23/23 Eviction Status Update: An eviction was filed on August 17, 2022, due to past due rent, voided payments, and high electric bills. The court actioned the eviction on May 9 and provided a court date of August 4, 2023, at 9 am.
As of June 1, 2023, the court date is confirmed and scheduled for August 4, 2023.

10/5/23 Eviction Status Update: On 9/7, the property management notified us of the eviction process status. We are still waiting for the court to issue the default judgment. On 9/13, we initiated a Tree Line order to proceed with the eviction. However, this order is pending until the court signs the eviction order. As of 10/5, we are in a holding pattern, awaiting the court’s signature on the eviction order. Once that occurs, we can move forward with scheduling the lockout date and regaining possession of the property.

10/5/23 Eviction Status Update: The court date was set for 10/3/2023. The resident filed a case to the federal court, but it has been remanded back to the magistrate court. We’re contacting the clerk to request a new court date and will send an update as soon as we receive the notice. This resident was successful in this stall tactic. We are now currently pending a new court date.

9/5/23 Eviction Status Update: August 24, 2023: A court date has been scheduled for September 26. August 17, 2023: An eviction was filed. Additionally, the residents were informed about outstanding funds owed for March and April, which were during ongoing plumbing issues. Despite being displaced, they did not respond to communications from the Property Management (PM) Team, even when offered credit.
